The Will of Hugh Jenkins
dated 10 April 1800
In the name of God Amen I Hugh Jenkins of the County of Rowan State of North Carolina, Being weak in body but of sound Disposing mind and memory, do this tength day of April in the year of our lord one thousand eight hundred make and publish this my last will and testament in manner following to wit-
In primus I give and bequeath unto my dearly beloved wife Mary Jinkins all my estate real and personal during her natural life and after her death to be disposed of in manner as hereafter directed, And I further devise to my wife Mary and to her heirs forever A Certain tract of Land supposed to contain 300 and 40 acres and commonly known by the name of Luckies plantation Provided my son Aron should no return during the life of my said wife. But in case my son Aron Jinkins should return during the natural life of my said wife then I devise the said tract of land known by the name of Luckies plantation to him and to his heirs forever-
2nd I give and devise to my daughter Ann Cowan wife of Willliam Cowan and likewise to her husband the said William Cowan the sum of ten pounds in money goods or merchandise to be paid when convenient time give leave which sum is to be raised and levyed out of my estate
3rd I give and devise to my daughter Mary Stewart and also to her husband Matthew Stewart equally between them the sum of ten pounds to be raised and levied out of my estate,
4th I give and devise to my daughter Mary Stewart one lot in the town of Salisbury in the West square of said town No 44 in the plan of sd town-
5th I give and devise to my two granddaughters Jane and Polly Cowan daughters of William Cowan the lot in the town of Salisbury known in the plan thereof by No. 33 in the plan of said town to be divided equally between them.
6th I devise to my sons Joseph Samuel Moses and Hugh Jenkins and to my two daughters Mary Kilpatrick wife of David Kilpatrick and to Susanna Johnston wife of Robert Johnston & to their heirs for ever in equal proportion 200 acres of land adjoining the springs commonly called the Cataba Springs and one hundred and twenty acres adjoining the sd Springs being the ballance of Wills tract of land on his said plantation as hereafter directed.
7th I give and bequeath to my son Moses Jinkins during his natural life one tract of land being the tract of land on which I now live & which I purchased from Andrew Hampton after the death of my said son Moses I give and bequeath the said tract to his two sons Hugh and Stuart Jinkins equally to be divided amongst them & to their heirs forever.
8th I give and divise to my son Samuel Jenkins 20 acres of Land part of the plantation on which I now live to be so laid out as to comprehend the improvement on which the said Samuel Jinkens now lives which 20 acres is to be compleated or added to the number of acres to the tract of Land commonly called Houstons plantation & then I give and bequeath the one half of the said tract of Land to him and to his heirs forever also to lotts in the town of Salisbury known in the plan of sd town no 36 & 42 to him and his heirs forever
9th I give devise & bequeath to Mary Kilpatrick my daughter wife of David Kilpatrick the other half of the said tract of Land commonly called Houstons plantation to be so divided as to give my daughter Mary the Improvement whereon she now lives & having regard to the 20 acres so as to give my daughter Mary one half of the whole number of acres computing the 20 acres with the original tract to the sd Mary and to her heirs forever.
And further I devise to my grand son Jinkins Kilpatrick one lot in the town of Salisbury known in the plan of sd town no 51 to him and heirs forever.
-- Also to my grand daughters Mary & Susanna Kilpatrick one lot in the town of Salisbury known in the plan thereof by no 52 to them & heirs forever.
10th I give and bequeath to my son Hugh Jinkins the privilege of the benefit of the plantation on which I now live his lifetime and at his death to his heirs and assigns forever and if my said son Hugh Jinkins should have no heirs then the said plantation to be sold and divided equally amongst my legatees as named & specified in this testament. Also the said lotts in the town of Salisbury known by the following numbers no one in the North square also no 41. 50. 49. and 57 these lotts to him and his heirs forever But, in case he should have no heirs then these lotts also to be sold and equally among the legatees also.
11th I give and bequeath to my grand daughter Polly Jinkins daughter of my said son Hugh Jinkins one lot in the town of Salisbury known in the plan thereof by no 43 to her and her heirs forever -
12 Also I Devise to my other grand children vis David Jinkins and Ann Roberson wife of Hugh Robison during their natural life and after their death to David & Richard Robison to be divided equally between them one lot in the town of Salisbury by no 20 in the plan of sd town and in the west square thereof
Also I devise to my Grand Son David Jinkins & his heirs forever two hundred acres of Land part of a tract of Land known by the name of Wills plantation lying in the County of lincoln the sd 200 acres to be so laid off as to comprehend all the improvement & to extend for complement towards Mr. Forneys and to have as much as possible of the original tract next the Springs commonly called the Cataba Springs -
I further devise my Negro Man Jo to my son Moses at his mothers death that is at the death of my sd wife Mary Jinkins Lastly I Give and devise to my grand daughter Sarah Trott Wife of Benjamin Trott all that property mentioned in those Deeds that are now in Mr. Trotts posessions and which I as administrator of my son James Jinkins reserved for her Sarah Jinkins and her heirs forever.
Finally I appoint my son Joseph Jinkins and my wife Mary Jinkins Executors of this my last will and testament and I do hereby Disannull & revoke all and every other Will or wills or testaments & declare this and no other to be my last will & testament signed published & declared to be my last will and testament in the presence
