The Will of Henry B. Kirby
dated 27 December 1817
In the name of God Amen: I Henry B. Kirby of the County of Halifax and State of Virginia being aged and indisposed in Body but of perfect mind and memory thanks be God for the same do make constitute and ordain this and none other to be my last Will and Testament in form and manner following that is to Say my Will and desire is that all my Just debts first be paid by my Executors hereafter named.
Item I give and Bequeath to the heirs of my deceased Son Obediah Kirby Two hundred and Sixteen Acres of Sand {Land?} it being my River tract which I made him a deed for in his life time and which hath been. Sold by his Executor in full of his proportion of My Estate as he and his heirs hath had more of my Estate than I am able to give the rest of my children.
Item I give and bequeath to my Son Jeremiah Kirby Two hundred acres of Land adjoining the land that I gave to my Son Richard Kirby whereon he now lives to him and his heirs and assigns forever.
Item I Give and bequeath to my Son Richard Kirby two hundred acres of Land whereon I now live to him and his heirs and assigns forever and my Shot Gun forever.
Item I Give and bequeath to the heirs of my daughter Easter Farmer deceased. one hundred Dollars to them and their heirs forever.
Item I Give and bequeath to my daughter Orpha Hamlin one good cow and calf to heirs & assigns forever.
Item I give and bequeath to my son Hezekiah Kirby one good feather Bed and furniture during his life and then to Orpha Hamlin Edith Anderson and Mary Kirby to be equally divided between them and their heirs and assigns forever and they and Each of them an to furnish the said Hezekiah Kirby with good and suficient proportion of clothing during his life
Item my will and desire is that my two Sons Jeremiah and Richard and their heirs take charge of my Son Hezekiah Kirby during his life finding him good bedding when necessary with Sufficient food & Raimial as he is a person of unsound mind and that each of my sons and their heirs contribute for that purpose each making in the whole ten pounds a year during the life of the Said Hezekiah Kirby
Item I give and bequeath to my four daughters Sarah Furgason Orpha Hamlin Mary Kirby & Edith Anderson one hundred Dollars Each and all the remaining part of my Stock house hold & kitchen furniture plantation ???? to them their heirs & assigns forever
Item I give and bequeath to Joel Kirby Son of Jeremiah Kirby all of my Blacksmiths tools to him and his heirs and assigns forever
Item I give and bequeath to my Grand Son James Kirby Son of Richard Kirby one young bay mare to him and his heirs and assigns forever
Item Lastly I nominate and appoint my son Jeremiah Kirby my nephew Richard Kirby and John S. Vaughn Executors of this my Last Will and Testament In ??? where of I have hereunto Set my hand and affixed my Seal this twenty Seventh day of December 1817
