Will of Joseph Jenkins
dated 11 February 1821

Lincoln County

Be it known to all persons whom it may concern that I Joseph Jenkins of the State and County aforesaid Being in a low state of health but of sound mind and memory do on this 11th day of February 1821 make and ordain this to be my last will and testament and do hereby dispose of my Estate both Real and Personal in the following manner viz

1st To my Son Hugh Jenkins I give and bequeth my Grist Mill with Twenty Acres of land Joining his own line To include said Mill and Seat the lower line of said Twenty acres is to crop the creek above My fence just below the wagon ford below the Mill and is to contain ten acres on each side of the creek.-

To him my said son Hugh during the term of his natural life and if he has Children born in lawful wedlock then to him his heirs & assigns forever And if he has no heirs as aforesaid at his decease the said Mill and Twenty acres is to descend to the Heirs of my son David Jenkins

2nd To my son David Jenkins I give and bequeath the plantation whereon I now live with all the land I now possess on the waters of Long Creek Except the Twenty acres above given to Hugh Two Him the said David Jenkins his heirs and assigns forever Under the Incumbrance that my unmarried Daughter shall have her living on the plantation while she lives single and have one fireplace to her self if required

3rd To my Six Married Daughters Sarah, Susanna, Ann, Betsey, Margaret & Agness I give and bequeath to each the Negroes they have had Delivered to them by Me and to my said Daughter Margaret I give & bequeth a Negro Girl named Fan. and to my said Daughter Agness I give & bequeath a Negro boy Named Cupid, to them and each of them their heirs and assigns forever

4th To my Daughter Mary I give and bequeath one negro woman named Jean with her two children George, and Bob. one Horse Saddle & bridle Her Bed and furniture claimed by her Her chest and dresser furniture and Spinning wheel also four Cows and Calves to her, her heirs & assigns forever --

5th My Negro Boy Andy now in possession of my son David and my Negro Man Simon I give and bequeath to my said son David his heirs and assigns

6th The lands owned by me at the Catawba Springs Together with all my interest in the lott including the said Springs I allow My executors to sell at Public Sale On such credit as they think will be proper and of most advantage to the heirs and the proceeds of said sale to be equally divided between my said seven Daughters. My Still and Crop cut saw I leave to my two sons share and Share alike. The remainder of my property not herein Specified I allow to be equally divided among all my children I allow my Executors to divide it into nine Lotts as equally as they can and the Legatees to draw each one for his or her Lott. Provided nevertheless that that if any of my said Children do not attend by themselves or their agent to receive their Lot as aforesaid after having notice then of then I allow my executors to sell the Lot at a reasonable credit and the money arising from said sale to belong to the Heir or Heirs of the Lot or Lotts sold as aforesaid. But not to be sold if it can otherwise be divided and received by the several owners-

6th I do hereby Appoint My said sons Hugh and David my Son in Law Jacob Carpenter and William I. Wilson Executors of this my last Will and Testament hereby revoking and Disannulling all former wills and Testaments by me made and declareing this and this only to by my last will and Testament In Testamony whereof I the said Joseph Jenkins have hereunto set my hand and seal the day and Year first herein written
the words "Just below the wagonford" was interlined in first page before signing.
